2. Acceptance of Terms

By accessing or using EventTrack ("the Service"), you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you may not use the Service. We reserve the right to update these terms at any time, and your continued use of the Service constitutes acceptance of any changes.

3. Description of Service

EventTrack is a cloud-based software-as-a-service (SaaS) platform designed for managing medical event staffing operations, including event scheduling, employee management, shift assignments, time tracking, invoicing, and billing. The Service is intended for EMS companies and event medical service providers.

4. Health Information Disclaimer

EventTrack does not collect, store, process, or transmit Protected Health Information (PHI) as defined under the Health Insurance Portability and Accountability Act (HIPAA).

The Service is designed for operational and business management purposes — specifically event scheduling, staffing, time tracking, and billing. EventTrack is not an electronic health record (EHR), patient care system, or medical billing system. No patient data, medical records, treatment information, or individually identifiable health information is collected or stored within the platform.

Users are prohibited from entering PHI or patient information into any field within the Service. LiveResQ, LLC assumes no liability for any unauthorized entry of PHI by users.

5. User Accounts & Access

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use. LiveResQ, LLC reserves the right to suspend or terminate accounts that violate these terms.

Account access is managed through role-based permissions (admin, manager, employee, host, etc.). Organization administrators are responsible for managing user access within their tenant.

6. Platform & Infrastructure

EventTrack is built on the Base44 platform, which provides the underlying infrastructure including authentication, database management, and hosting services. By using EventTrack, you also agree to Base44's terms of service and privacy policies.

  • Authentication and user management are handled by Base44's secure authentication system
  • Data is stored securely using Base44's managed database infrastructure
  • All data transmission is encrypted via HTTPS/TLS
  • Base44 maintains industry-standard security practices for data protection

7. Payment Processing

Payment processing is handled by Stripe, Inc., a PCI DSS Level 1 certified payment processor — the highest level of certification in the payments industry. By using payment features within EventTrack:

  • Credit card numbers and sensitive payment data are processed directly by Stripe and are never stored on EventTrack servers
  • All payment transactions are subject to Stripe's Terms of Service
  • Payment data is protected under Stripe's Privacy Policy
  • Stripe maintains PCI DSS compliance, ensuring the highest standards of payment security
  • EventTrack only stores Stripe customer IDs and transaction references — never raw card data

8. Email & Communications

EventTrack uses Resend for transactional email delivery (invoices, notifications, invitations). By using the Service, you consent to receiving operational emails related to your account and event activities. Email communications may include:

  • Account invitations and onboarding emails
  • Invoice delivery and payment confirmations
  • Shift assignments, reminders, and notifications
  • System notifications and announcements

9. SMS Communications

If your organization enables SMS notifications (optional add-on), messages are sent via Twilio. Standard messaging rates may apply. By opting into SMS features, you consent to receiving text messages related to shift assignments, reminders, and operational alerts. You may opt out at any time by contacting your organization administrator.

10. Data Ownership & Privacy

You retain ownership of all data you enter into EventTrack. LiveResQ, LLC does not sell, share, or distribute your data to third parties except as required to operate the Service (e.g., payment processing via Stripe, email delivery via Resend).

  • Organization data is isolated by tenant — each organization's data is separate and inaccessible to other organizations
  • We collect and store: names, email addresses, phone numbers, business addresses, and operational data (events, shifts, invoices)
  • We do not collect: Social Security numbers, patient data, medical records, or financial account numbers (beyond Stripe references)
  • Upon account termination, you may request a full export of your data

11. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Enter Protected Health Information (PHI) or patient data into the system
  • Attempt to gain unauthorized access to other tenants' data
  • Interfere with or disrupt the Service or its infrastructure
  • Reverse engineer, decompile, or attempt to extract source code
  • Use the Service to send spam or unsolicited communications

12. Service Availability & Warranties

EventTrack is provided on an "as is" and "as available" basis. While we strive for high availability, we do not guarantee uninterrupted access to the Service. LiveResQ, LLC disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We reserve the right to perform scheduled maintenance, during which the Service may be temporarily unavailable. We will make reasonable efforts to provide advance notice of planned maintenance.

13. Limitation of Liability

To the maximum extent permitted by law, LiveResQ, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claim arising from these terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

14. Subscription & Billing

EventTrack operates on a monthly subscription model. By subscribing, you agree to pay the applicable fees for your selected plan. Subscriptions automatically renew unless cancelled. Refunds are handled on a case-by-case basis. Plan changes take effect at the start of the next billing cycle.

15. Termination

Either party may terminate the agreement at any time. You may cancel your subscription through your account settings or by contacting support. Upon termination, your access to the Service will cease, and your data will be retained for 30 days before deletion, during which time you may request an export.

16. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts located in Cook County, Illinois.
